This Agreement regulates the rights and obligations of the parties concerning the sale, delivery, and other matters related to the products/services (“Product/Products”) that the BUYER (Consumer) wishes to purchase by placing an order on the electronic commerce website of the SELLER, https://www.kikaclothing.com/ (“WEBSITE”), including cases where the BUYER places an order via the mobile device application. After the BUYER confirms this Agreement on the WEBSITE, the price of the ordered Product(s) and any additional costs will be collected according to the payment method selected.

Article 2: SUBJECT OF THE AGREEMENT, PRODUCT, PRICE, PAYMENT, AND DELIVERY
The type and nature of the products (goods/services), quantity, brand/model/color, unit price(s), sales price, payment (collection) details, and delivery information, including the location specified by the BUYER, are as follows.
If the delivery company does not have a branch at the BUYER’s location, the BUYER must collect the order from another nearby branch as notified by the SELLER (the necessary information will be communicated to the BUYER via email, mail, SMS, or phone). Other delivery-related matters are specified in Article 7 of this Agreement.

Article 3: INFORMATION TO BE PROVIDED TO THE BUYER PRIOR TO AGREEMENT ACCEPTANCE
The BUYER agrees and acknowledges that they have been informed about the following matters before accepting this Agreement on the WEBSITE and before entering into any order and payment obligations. The information is available on the relevant pages of the WEBSITE, which the BUYER confirms they have reviewed:
- The title and contact information of the SELLER, and up-to-date promotional information.
- The steps of the sales transaction when purchasing products from the WEBSITE, and tools/methods for correcting incorrectly entered information.
- Information regarding the professional chamber to which the SELLER belongs (Istanbul Chamber of Commerce) and contact information for acquiring relevant behavioral rules (Phone: 4440486, www.ito.org.tr).
- The SELLER’s privacy policy, data use/processing rules, electronic communication rules, and the permissions granted by the BUYER, including the BUYER’s legal rights, the SELLER’s rights, and the methods for exercising these rights.
- Shipping restrictions for products set by the SELLER.
- Payment methods accepted by the SELLER, as well as the total price of the products (including taxes and any related costs that the BUYER must pay to the SELLER).
- Information about the delivery of the products, shipping/delivery charges, and other details regarding payment/collection and delivery.
- The products and services for which the BUYER does not have the right of withdrawal.
- The conditions, duration, and procedure for exercising the right of withdrawal, and that the right may be lost if not used within the prescribed period.
- If the product is used in a manner inconsistent with its instructions, normal functioning, or technical features during the right of withdrawal period, the BUYER’s request for withdrawal may not be accepted, and in any case, the BUYER will be responsible for any damage. The SELLER may deduct a suitable amount from any refund given to the BUYER in case of any damage or modification.
- If the right of withdrawal exists, the procedures for returning products to the SELLER, as well as the related costs (including return methods, cost, product price refund, and deductions for reward points accumulated/used by the BUYER).
- If the BUYER is a legal entity purchasing the products for commercial or professional purposes (e.g., bulk purchases), they cannot use “consumer rights,” including the right of withdrawal.
- The terms and conditions of sale in this Agreement, and that the Agreement will be electronically sent to the BUYER after acceptance and can be stored and accessed for the requested duration. The SELLER may also keep the Agreement for a period of three years.
- In case of disputes, the BUYER can send complaints to the SELLER and may make legal applications to the District/Province Arbitration Boards and Consumer Courts in accordance with the provisions of the Law No. 6502.
